OK, GREAT!  HERE ARE SOME THINGS YOU SHOULD KNOW

CARBON CREDITS:

Participants shall receive royalty payments for their carbon stock annually, effective after the pre-inspection period has been satisfied.  The amount of royalties received throughout the duration of the program is directly related to current retail prices and availability of carbon stock, and is calculated through ABR.

 

ABR-  The Annual Base Rate is determined by the following:

·                The total of all carbon quantified within that fiscal year.

·                The total amount of approved wooded acreage you provide.

·                The retail price of carbon stock sold for each occurrence.

·                Management recovery fee (not to exceed 39%)

 
 

 
   
   
   
 

LETS DISCUSS WOOD VALUES AND HOW THEY ARE IMPORTANT TO EVERYONE


TIMBER APPRAISALS:

  • Expected wood values are based on current market conditions, and are given only as a fair estimate of actual wood values.  Since we work for you on a percentage, accuracy is very important to us.

  • Actual wood values are known after a harvest operation is completed, and lumber has been graded accordingly. 

 
   
   
   
   
 

PAYMENT OF WOOD/CARBON PRODUCTS:

  • History has told us that the most accurate way to deliver fair, honest pricing means providing a guarantee of fair market value on all wood harvested, including all carbon sequestered, measured and marketed, relative to the time and date of an approved harvest or carbon sale. 

  • Under this arrangement Michigan Timber Conservation LLC, will access a management fee not to exceed 39% of the total sales generated from a harvest and/or carbon sale.  This allows your forest studies and evaluations to take place, at no out of pocket cost to you.

  • Forest studies and evaluations performed by Michigan Timber Conservation LLC, are accepted as valid consideration for initial payment of a scheduled harvest.  This includes any baseline harvests necessary to meet program requirements.

  • Balances of harvest operations and carbon sales are paid in full upon the completion of each occurrence. 

  • Notification of payment will be provided to all participants before a payment has been sent. 

TIMBER HARVESTING:

Future harvesting may be needed from time to time, improving the quality of your forest.  In the event that a timber harvest operation is needed, trees deemed to be detrimental to the forest by Michigan Timber Conservation LLC, obtain full discretion as to which trees are to be harvested, so long as the timber being removed meets the recommendations of the Participants current management plan, developed by the Participants, and their assigned forester.

BASELINE HARVESTING:

Baseline harvests are intended to remove trees detrimental to positive future growth, avoiding any negative reflections that may be present in an un-managed woodlot.  Determination of baseline harvesting is the sole responsibility of Michigan Timber Conservation, llc and shall never be harvested without prior approval.

YOUR PARCEL INFORMATION:

List all properties owned that may qualify for the program.  You can find parcel numbers, including the county they are located on your property tax bill.

Please Read our Agreement

This agreement gives Michigan Timber Conservation, llc, further referred to as “MTC” its agents, subcontractors, and assigns the full and free right to ingress and egress with equipment necessary to manage the land(s) described above, for the purpose of executing scientific studies, evaluations, and any scheduled timber harvests related to the secretion and capture of carbon through long lived wood products. 

This agreement is granted for a minimum of 15 years, following a 12 month pre-inspection period effective at agreement signing.  The participants warrant that he/she/they have the right to deed management activities with the understanding that the MTC manages and controls all carbon and timber resources on the above-described property for the duration of the agreement.

 

EARLY RELEASE:

In the event that conflict arises regarding this agreement, and cannot be resolved through discussion by the parties as a first step; then either party may request in writing to the other party that the area of disagreement be presented to arbitration with American Arbitration Association and subject to their rules.

All management activities shall cease at the time of the request for arbitration, with the exception of removal of trees and logs that have already been cut during a harvest operation, preventing any market loss to either party. All arbitration proceedings shall commence immediately and shall be completed in the shortest possible time, the parties agreeing that time is of the essence. All costs of the arbitration shall first be paid by the party requesting the arbitration and shall secondly be charged against the party determined by the arbitrator to be at fault.

The determination by the arbitrator shall be final and binding on both parties and shall be submissable to court for judgment pursuant to statute.

 

Lets Finish Up With Naming The Participants, And Release Them From Any Liability.

 

RELEASE FROM LIABILITY:

The named Participants or his agents shall not be liable for injury or damages suffered by the MTC, its employees, contractors, or assigns, resulting from the use of the premises herein described or rising out of the performance of any act or thing required by the terms of this agreement. The MTC and/or its representatives releases the named Participants from any claims or demands that they may have of whatsoever kind or nature in any manner arising out of a thing related to this agreement.

The Participants are responsible for providing all necessary ingress and egress for the MTC, and its assigns to complete the terms and obligations of this agreement. This agreement is binding on all heirs, executors, administrators, successors, and assigns of all parties. This agreement is renewable, unless notified in writing, by either party within 30 days of the completion of this program.


This agreement shall be constructed according to the laws of the State of Michigan.
